Your use of third-party platforms through 1stly remains subject to those platforms' respective terms of service, including but not limited to:

  • Google Ads Terms of Service
  • Meta Business Tools Terms
  • TikTok for Business Terms

5. AI-Powered Features

Our Service uses artificial intelligence to analyze data and generate recommendations. You acknowledge that:

  • AI recommendations are suggestions and not guarantees of performance
  • You are responsible for reviewing and approving any changes before execution
  • Past performance does not guarantee future results
  • AI-generated content should be reviewed for accuracy and compliance

6. Acceptable Use

You agree not to:

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee any specific advertising results, performance metrics, or return on investment.

12. Indemnification

You agree to indemnify and hold harmless 1stly and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your advertising content or practices

13. Termination

You may terminate your account at any time. We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or us.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
